I have a question from the Touhou community. Me and my friends have been working on our own Touhou game for the past couple years as a tactical role playing game. While I’m not ready to release any details until it’s done, I had a few questions about staying within ZUN’s guidelines.

1. Basically we’ve made this game as a hobby and kept throwing new things onto it as time went on. I am confused on the monetization allowed for it given the amount of artwork and music we’ve made for it. The guidelines say monetization isn’t allowed but then I see Genso Wanderer, Luna Lights, and several others actually doing the opposite of those guidelines just fine. Are we supposed to go to someone about this if that’s our intent after all’s said and done? We haven’t even crowdfunded.

2. We aren’t Japanese. It’s just six guys from the US doing this with our degrees and knowledge of game design. Is that going to be an issue?

3. We’ve tried to stay within the personalities of the characters but took a few liberties when it just got confusing. Is that going to be a strike against us if it’s too far off? How would we even know? Also, we’re avoiding NSFW stuff completely, but still. There’s no guideline on this. We’ve already hard coded choices and progression branches into the game. It’d be a pain in the ass to change that.

4. Is there someone we can actually go to to get an OK if we want to release it without an issue?

Usually you don't need to ask when doing something like that. then again, I wouldn't know.
Normally the only way you fuck up is if you get a C&D like ShEXE.

I think the whole monetization thing is more for crowdfunding and or things like spotify but honestly I dont think zun really cares.

as far as I understand, basically ZUN is kind to "doujin works"
as long as you follow the guidelines concerning fan creation, you won't face big problems
fan works in accordance with the guidelines would be automatically considered legal, while for business works specific authorization is required
if you still have any other concerns, why hesitate to contact Team Shanghai Alice?

Okay that was quick…..basically he’d want to have a cut and some sort of agreement. That’s simple enough I guess. Basically the rules are, you can publish but don’t screw over ZUN beforehand and be sure to ask him for some sort of agreement between both parties. There’s also apparently no Doujin Circles in the US.

It was announced in late 2017 that you can release fangames on steam. The official guideline page doesn't seem to go in depth as the above matome of the stream where it was announced.
Basically if you're a company you need permission, but if you're a doujin circle you can do what you want but you bear all responsibility.

I’m more confused about Doujin circles though. Me and my friends aren’t a company, so are we automatically a Doujin circle since we work together on a Touhou fangame? Do I need to “officially” apply as a Doujin circle?

I also believe asking Phoenixx is a good choice for if it’s good enough. They seem to be the likely company to work with to avoid legal issues with ZUN. For steam it apparently doesn’t matter anymore.

Shanghai.exe-Genso network.
It was a megaman BN inspired/clone game. It got abandoned by the author because at some point he asked for money, this got the attention from Capcom who decied to sue and ask to cancel the game.
It got revived and finished by some anons from /jp/.
There are still some post-game contents that are need to be finished.

I don't know if it counts as a reskin. I played an early release years ago when I was learning japanese and it seemed like a fully original creation that visually paid homage to the MMBN series. Having played both I can say it's worth a look even if you don't have nostalgia for those megaman games.
