OK, people from #katawa-shoujo will probably guess who this is, so here is how I view it.

- You can extract data for personal use.
- You can extract data for use within fair use (joke shoops, etc...)
- You can distribute the entire game as-is.
- You can distribute scripts to extract the content (might fall foul of the DCMA or some bullshit?, but the archived format doesn't really count as DRM).
- You can NOT distribute the game modified (with data extracted).
- You can NOT distribute the game content partially, this would be classed as a derivative.

Now, they are actually being pretty accomodating about this, all things considered, they just don't like people talking about it on the IRC channel/forums. Yes, they do get touchy, but that's the way it is.

What it boils down to is that if the creator(s) are willing to sue over intellectual property, all they really need to do is point out where a copy has been made.
