If a work is derivative the copyright holders should have all the rights to it. BTW, isn't derivative dojinshi ALREADY illegal in Japan? Most copyright holders just let it be, because many of them themselves have their roots in dojinshi business.

Nintendo for example doesn't allow disgusting lewd dojinshi to be made, and has succesfully applied the current law to such cases.
