you will not be getting any 'strikes' in the first place, anyway. you get a 'strike' when a copyright holder sends your ISP a notice that they've seen someone with your IP downloading a torrent with their stuff in it.

in the past the ISP just forwarded these letters to you, then you did nothing because there's no legal basis. now they are making ISPs tell you to please buy things. if you've never gotten one of those letters you won't be getting one of these 'strikes.'

“Intellectual property”
Publishers and lawyers like to describe copyright as “intellectual property”—a term also applied to patents, trademarks, and other more obscure areas of law. These laws have so little in common, and differ so much, that it is ill-advised to generalize about them. It is best to talk specifically about “copyright,” or about “patents,” or about “trademarks.”

The term “intellectual property” carries a hidden assumption—that the way to think about all these disparate issues is based on an analogy with physical objects, and our conception of them as physical property.

When it comes to copying, this analogy disregards the crucial difference between material objects and information: information can be copied and shared almost effortlessly, while material objects can't be.

To avoid spreading unnecessary bias and confusion, it is best to adopt a firm policy not to speak or even think in terms of “intellectual property”.

The hypocrisy of calling these powers “rights” is starting to make the World “Intellectual Property” Organization embarrassed.

"Property" and "ownership" are analogies. You haven't found this huge smoking gun in people's rhetoric. There's a reason it's "intellectual property" and not "property".

In admittedly less buzzwordy terms, copyright is fine. It's just that copyright should legally belong to the author and no third party should be given a monopoly on copyrights or copyrights-by-proxy (e.g. through strict contracts on what authors can do with their own work).

Still, the transferral of copyrighted data shouldn't be illegal. I think it's immoral if someone worked hard on something to try and earn money from it and you take it for free (even if you have no intent to redistribute or sell it and wouldn't have bought it anyway), but it shouldn't be illegal. If you want to steal my drawings or software, go right ahead. Just don't be a dick and say you made them or whatever. I don't mind if you're just a selfish jerk as long as you keep that to yourself.

“Theft”
Copyright apologists often use words like “stolen” and “theft” to refer to copyright infringement. This is spin, but they would like you to take it for objective truth.

Under the US legal system, copyright infringement is not theft. Laws about theft are not applicable to copyright infringement. The copyright apologists are making an appeal to authority—and misrepresenting what authority says.

Unauthorized copying is forbidden by copyright law in many circumstances (not all!), but being forbidden doesn't make it wrong. In general, laws don't define right and wrong. Laws, at their best, attempt to implement justice. If the laws (the implementation) don't fit our ideas of right and wrong (the spec), the laws are what should change.

“Piracy”
Publishers often refer to copying they don't approve of as “piracy.” In this way, they imply that it is ethically equivalent to attacking ships on the high seas, kidnapping and murdering the people on them. Based on such propaganda, they have procured laws in most of the world to forbid copying in most (or sometimes all) circumstances. (They are still pressuring to make these prohibitions more complete.)

If you don't believe that copying not approved by the publisher is just like kidnapping and murder, you might prefer not to use the word “piracy” to describe it. Neutral terms such as “unauthorized copying” (or “prohibited copying” for the situation where it is illegal) are available for use instead. Some of us might even prefer to use a positive term such as “sharing information with your neighbor.”

I agree with what you're saying though, and I'm cool with derivative works. Nintendo and Square routinely sue people for making fan games and stuff, even if they're not for profit. I'd be so pleased if I created characters and settings and some Japs created porn comics of them.
The only big American company I can think of that is cool with this is Lucasfilm. For a company owned by a man who destroys copies of his own films, they were really cool with Star Wars fan films and held competitions and stuff. Now they're owned by Disney so who knows what will happen. A year or two ago there was a thread here about some Japanese developer who was threatened by Disney because he used the Mickey Mouse logo for purposes of parody in one of his games.

They've had this for years in the UK. Some ISPs don't even give you a strike, they just revoke the Internet, tell you what you did wrong and don't reconnect you until you say sorry to the copyright holder who is threatening your shit (I shit you not).

This has made no difference to my piracy, ever.

More often than not, they only ever shop in people with IPs that have been continuously uploading. So, don't seed or upload anything with a copyright belonging to the Jew and you should be okay.

NEETs have a variety of different fucked up sleep rhythms. I woke up a 2am after falling asleep at 4pm yesterday.

Yeah man NEETs don't obey the same bodily cycles as other human beings. NEETs are post-human.

meh, oh well.

I don't really think this is even going to matter to most people on /jp/, since the entire system is dependent on copyright holders actually caring enough to catch you themselves. At worst it gives you five chances to figure out a better way to pirate the stuff they actually care about. I'm not even sure it will matter to ``average'' pirates downloading new movies and music.

I'm pretty sure my ISP is not participating in this. They didn't participate in the other three strikes rule, and they didn't put in any bit caps for this area when they became popular elsewhere. As a matter of fact, they recently upgraded customers' service.

I wonder what they'll do when Google Fiber comes.

Piracy will never be a serious crime because no country can afford to put half their population in prison. It's just another law they will save for enforcing only when somebody with power wants somebody arrested for no reason.
