You wouldn't be able to sell it through an online service like steam, atleast. These rules were updated from the old rules which originally stated "If you want to sell touhou doujin works outside of doujin stores, then you must ask permission from ZUN".

I don't think he'd mind if someone made a game and sold it at an american 'doujin' convention. He certainly doesn't mind the overseas touhou conventions in taiwan and china. But those are a bit different than offering your game through Steam. My guess would be he just wants to avoid third parties commercializing touhou.

Funny that you post this, IIRC at the time ZUN posted the revised rules, it was a bit after the 'official translations' for the project aja touhou games. I remember speculating that Project Aja probably wanted to sell overseas but couldn't get permission from ZUN, and this might of made ZUN decide he needed to update his rules for secondary works.

I honestly believe that ZUN doesn't care about pirating, especially overseas (I even remember reading a rumor on 2ch about how 台魔王 was actually ZUN, which gave me a laugh). If he did we would have touhou on steam already. He seems to be more concerned with controlling how commercialized touhou becomes. He's not against commercializing it, per se, but he wants to control it. For example, touhou doujin music can be paid for at karaoke bars, and a share of the profits go to ZUN. As for why he is more strict on games, I think he does not want secondary interpretations of Touhou to be thought of as canon. The games are how he expands the touhou universe, and he wants to be in complete control of that. Since the touhou games are not officially released in english yet, he's not about to let secondary works get released under the touhou name and define 'touhou' overseas.

As for why he hasn't released Touhou officially in english yet, your guess is as good as mine. I'm inclined to think that he just views the whole process as a pain in the ass that he doesn't need. So what if everyone overseas pirates it? He'd rather just drink beer and not worry about it.

So buy the products to satisfy yourself as a touhou fan, supporting it with your money if you feel it is worth it to you. I do.

It has nothing to do with keeping Touhou for Japanese only, it's about keeping it low profile. Besides there are plenty of stores that sell the official games worldwide.

People have "localize" freeware Japanese rm2k games before and sold it on Steam. I don't remember the name of the game, Faune or something.

I remember the butchered localization we got of Sora (Suguri 2) and how it didn't play back some sound effects and had textbox glitches, and people paid money for that.

As it's been said already, ZUN probably wants to maintain the integrity of his work by disallowing overseas sales, but even if these guys get ZUN's permission, that will still be threatened. I love a lot of Touhou fan games, but I don't want 14-year-olds playing them and treating them as the "original" games. Especially since some of them will do a little research, play The Embodiment of Scarlet Devil, then decide, "Wow this game is shit. The art is terrible compared to Eastern Project Pocket Wars. Why is Sarah Isaacs wearing a maid costume?!"

Plus it might lead to more terrible Western fan games, like the one that (actual) 10-year-old was working on, and KoG's games. ZUN has quite a few reasonable conditions for creating derivative works, and like hell are a few DeviantART faggots with a pirated copy of Flash going to care about those:
