The other day, I was sitting in my room, going about my business, when I saw a cop car pull up outside my window.

My heart was racing and I was panicking like crazy. I grabbed my PC and a hammer and bolted for the next room, ready to extricate my HDD and smash the platter into pieces.

I had the HDD out and hammer in hand, waiting for any noise outside my door. At which point I would do it.

I waited a good 15 minutes and didn't hear anything. I looked outside the window again to find that they had driven off.

I need a better plan for situations like that.

The argument here is that you are masturbating to arousing images of children. That is viewed as wrong, and having the images in the crime. You are not playing a game or reading a book where the character is aroused by children (otherwise Lolita and NHK ni Youkoso! would be illegal), you are the one performing the illegal and morally questionable actions.

I think it is hypocritical for people to collect lolikon images yet denounce photographic child pornography. Both are child pornography, neither are harming anyone. Both should be illegal and treated equally (as they are now in the US and UK), or both should be legal and free to share.

Most photographic child pornography is actually just nude ``child modelling'', often from an era or country where it was or is perfectly legal. That is why the children are smiling in nicely decorated sets. Videotapes of children raped by their uncles and submitted to alt.videos.pedophilia are a very small minority, and one even the people who get off to it would admit is wrong.
The children were rarely physically or mentally harmed at the time of the shoot, and their parents gave their consent. I fail to see how this is any less ethical than 2D child pornography such as lolikon. The idea people seem to have is that being *aroused* by these pictures is wrong and should be criminalized. That is why pseudophotographs are illegal.

This is only for the USA, but lets get some facts straight.

Loli isn't illegal in the US. It's just illegal to send "Obscene" content via mail or "public" medium. To decide if the images are obscene, they take a panel of random people and show them the images. If that panel deems the images to be obscene, then you're guilty of Public Obscenity (Not possession of CP.)

Quite simply, you won't get to defend yourself. The police will come and take your computer equipment, though you can get that back if you file the proper forms in time.

If I ever got into the situation, I'd argue that since you used private websites and private ISP networks, and you never publically showed the porn, that you couldn't have possibly committed PUBLIC obscenity.

If you read the news stories about stuff like this however, you find that the people being prosecuted either sent the stuff through mail, were browsing on a public computer, or also had CP. I think the likelihood of you getting V& for just looking at loli in your basement is slim to none.

I don't think owning CP should be a crime. SImply having the images hurts no one.

My problem with what you said is that it implies creators of loli manga and creators of actual child pornography are equal, which makes no sense.

Weren't there stories going around a few years back about the FBI having access to 4chan and the data of every poster on here? If they're searching everything for keywords, they may just happen upon this thread.

I will admit I am not up on my law jargon, but to me that suggests that:
a) It comes from somewhere else in America; or
b) It comes from somewhere outside of America.

Also, that it is a commercial transaction. If you are just randomly downloading it from public sites, it cannot be construed as a commercial transaction. That would be like saying randomly picking up and keeping someone's discarded newspaper is a commercial transaction.

They would've acted already. If they want new keywords to search for, sure. But, they would gain nothing be pursuing anyone in the thread.

It would take someone bragging about how they were a child pornographer for that to happen. And who would do that?

In any case, I have nothing to fear: I am as pure as freshly fallen snow.

Trucrypt has an option for a hidden operating system. You put in the key for the dummies when it's asking you for your password and it loads that one to show you have nothing incriminating.

I found this, which explains the physical locations involved:
http://www.law.cornell.edu/uscode/text/18/921

The commerce thing is interesting though. I could receive something through the mail for free. And why is it worded ``knowingly produces, distributes, receives, or possesses with intent to distribute'' rather than, say, ``knowingly engages in commerce or intent to distribute''?

Wikipedia claims that the ``interstate or foreign commerce'' part can refer to Internet communication in general. That sounds plausible to me; I don't see why obscene material should have to be bought or transactions take place from only certain locations.

Any law buffs here?

Well then I guess we'll have to disagree.

At this point you may as well just write, ``The music industry are hypocrites and liars.'' on a piece of paper. It would be just as ``poignant''.

This.

> mere possession of said images is not a violation of the law unless it can be proven that they were transmitted through a common carrier, such as the mail or the internet, or transported across state lines.

It gives the law itself as a source, which is a pain.

Perhaps I was wrong in >>8962418
Ultimately the difference in legality between *downloading* something and *possessing* it _does_ matter.

From what I've read over the past couple of hours, people seem to take fault with the way the law is written. So, fortunately, it's not just me.

I suppose the conclusion to draw from this is that lolikon is ``supposed'' to be illegal, but we're going to have to wait until someone is prosecuted for downloading lolikon (and only downloading lolikon) before we can confirm whether the law holds up. It is possible it will be struck down, like the previous law was.
