All that is required is a market where people can speak with money. It can be regulated as much as you'd like, as long as it still affords the consumer some choice.

If this were a communist country and you had coupons for cookies, then if there is a choice which cookies to get, then citizens can choose a choice they think is best. Then if manufacturers can respond to this to produce more of what people like, things work out.
