Wouldn't this be legal in Japan? I don't know anything about Japanese IP law but if seems like if people can make Doujin with Touhou characters, they can make card games too.

Except that Touhou is owned by ZUN. Doing this as a doujin publication in comiket is fine, doing this for PROFITS, is not.

Doujin has special rules which qualify them as fanworks or something and are required to have a certain type of business structure. The original owner of the IP can also demand that no fanworks be made.

an independent artist selling self-produced doujin at comiket is a world away from some large-scale corporate gambit to make money off the back of ZUN's intellectual property. mass-production without deference or recompense to the owner of the property is theft, and is therefore actionable.

at least, this is how it would be handled in a western market. i can't really comment on how it would be handled abroad.
