Seeing Shiravune, in theory pretty much anything can get onto Steam these days with enough cuts (aside from DT2-2, though even there they may have just given up). It is a shame they'll probably need to make cuts though even if an off site patch would make it irrelevant, Sona-Nyl would have been ideal for the much simpler "no explicit porn, but anything else is fine" policy that Steam had back when MG originally licensed it.

As a whole it had a much better shot of getting onto Steam had it been released in a timely matter as they picked it up in 2016 and titles didn't really start running into problems until 2018 (briefly) and 2019 (more significantly). Though weirdly being delayed until 2023/2024 vs 2021/2022 could have ended up helping since the environment for getting a title onto Steam in some form seems better today than it was a year or two years ago. If Muramasa were submitted today instead of when it was, it probably ends up on Steam (although likely with far more cuts than it was submitted with), and Aoi Tori will probably get onto Steam even if Amatsutsumi got blocked.

The change preventing as many permabans for full length titles seems to have happened right after the Chaos;Head reversal, likely to avoid more PR blunders. Valve seems to benefit quite a bit from the current system now, they get all of the sales for something like Nukitashi while not taking on any of the liability for content they are concerned about that is instead released off site.

Because genuinely all it takes one of these days is some bored journalist realizing this industry is basically getting away with selling porn to kids. They cut everything they can to get it onto Steam and not the adult store so they can sell it to EVERYONE, and all it takes is some kids looking at the top review to find the patch. All this stuff is going to have a reckoning someday unfortunately.

They also want to avoid directly referencing off site patches, but have obviously been ignoring them in the review process as it would take 20 seconds to realize that any Shiravune title was planned to have an off site patch. It likely comes down to liability with the content they force into patches, they want to avoid direct links on Steam itself so they can plausibly say that they aren't responsible for what happens off-site.

Valve is actually directly selling tons of porn though already, you don't need to look at what is in an off site patch for a story when R18 versions of stuff like Oppai Academy, the Cherry Kiss releases, and countless OEL R18 titles are on Steam (the last category is more likely to have "buzzworthy" names that lend itself to media stories, see Rape Day). There will inevitably be PR and legal problems in the future especially with the increasing amount of laws focusing on age verification in the US and Europe, but that would be true with or without R18 patches considering what Valve themselves are selling directly on site.

Yes but to access that side of the store you need to actually click a button saying you are 18+. When you cut the content, you bypass all of that and it's just openly available to anybody. You can't even beat it with parental controls. I'm honestly surprised Valve has let it even reach this point. The patch sites generally have just as much of an 18+ warning as Valve itself age checks. The future PR/legal problems are going to likely revolve around "video game giant Valve is selling porn", some third party 18+ mods for a AAA title, or some individual game (with or without an R18 patch) becomes a PR nightmare again, and the click through age verifications wouldn't do much to blunt any such story be they on Steam or on a third party site.
