So /jp/, I wanted to ask you something.

When I was in Japan I picked up an issue of Dengeki Hime and kind of want to buy a subscription to it through J-list. But I'm worried about the fact that about 5-10% (of at least the issue I have) is loli.

If I was to order this subscription would I just be asking for the partyvan to show up? Does anyone here have a subscription? I know Ill probably get a lot of trolls saying to wipe my HD and shit, but I really wanna know.

Canadian here- I've never imported magazines, but I have a bunch of stuff on my harddrive that might not land me in favorable circumstances due to the legal system twisting around terminologies. Anyway- think of it this way, they have drug cases, real crimes, they aren't going to care about your subscription to Dengeki Hime. I wasn't arrested for buying a few Yuri DVD's yesterday, I don't think you'll be arrested for this. (Although I bought mine in town, not over the net.)

I wouldn't import anything with loli hentai while Christopher Handley's case is still up in the air. There's not much of a chance that you'll get caught, but it's not something that I'd want to risk. Porn is not the issue. In the United States, it is a felony to transport anything 「obscene」through the U.S. postal system, where obscenity is decided on a case-by-case basis by a jury in every state. Playboy has been deemed not obscene and therefore legal, but what the O.P. is interested in probably would not anywhere in the southern or midwestern states.

Loli is ruled as an obscenity, which is a way to ignoring the first amendment. Essentially, fine to have, but if it's discovered, you go to jail for being 'offensive'. That means no postal office, or possibly internet connection, depending on how ' in sight' is determined.

Obscenity isn't a concrete or universal classification though. Just because it passed (or would it be failed?) the Miller test for one group of jurors doesn't mean that loli is officially labeled as obscene across the entire country. Obscenity is defined by the community where you live, so it's possible to end up with a jury that would not consider loli obscene. This further adds to the bullshit of obscenity laws because you can't be sure if what you own is obscene until you go to trial for it.

>> No.1866653

>>1866637

That's the trick, though. They need a search warrant approved by a grand jury to look in your closet or under your bed. Abortion is legal based entirely on privacy rights for example.

That is, abortion can be banned, but it's illegal for the medical records involved to be checked in order to prove they occurred.

Obscenity laws make perfect sense, or at least they would if they were executed properly.

They are intended to keep people from placing offensive material in the view of the public, which is fine, no one wants their kids seeing midget porn in bus adds.

>They need a search warrant approved by a grand jury to look in your closet or under your bed.

Wrong. Cops do not need a search warrant for anything, ever. They can search wherever and whenever they want as long as that search is reasonable. A warrant is merely a precaution which has a judge state beforehand that a search is reasonable and they will back it when it goes to trial, thus protecting their evidence from being dismissed.

I doubt they would search your house without getting one, but they don't need one.

Wrong. Cops need a warrant to search your house and if they don't have one you can tell them to fuck off. Also, they can only seize whats on the warrant and if they find cocaine for example while they are searching for porn they can't convict you for the drugs without a separate warrant.

>> No.1866751

There are situations where cops can (legally) search without a warrant, but they're rare and usually involve the person being searched to have done something massively stupid. You're right though that they can't randomly knock down doors looking for porn and drugs and the like, at least not if they want what they find to be admitted as evidence.

I really wouldn't worry about it, personally.
"transporting obscenity across state lines" laws have been around for decades. Whether it's "loli" or not is rather incidental. One in a blue moon some poor sod gets ramrodded by some obsessed small-town postmaster, but the odds are higher you'll win the lottery and then get killed by lightning.

As I understand it, you're not allowed to have photographs or digital composites of underages in sexual situations. (Digital composites were illegalized because people would otherwise claim that their CP wasn't real because they thought someone made it up out of whole cloth.)
