10605494 No.10605494[DELETED]  [Reply] [Original]

COMES NOW Assistant United States Attorney Craig Peyton Gaumer, for and on behalf of the Plaintiff, United States of America, and the Defendant, Christopher S. Handley, and the Defendant's attorney, Eric Chase, and hereby stipulate and agree that the following facts are true and correct and may be used by the Court to establish a factual basis for the plea of guilty to be entered by Defendant pursuant to the plea agreement, and for purposes of sentencing and any subsequent litigation between the parties:

1. In May 2006, customs officials intercepted a mailed package from Japan addressed to the defendant at [ANN: Address Removed] that contained approximately seven books of Japanese manga, specifically cartoon drawings of minors engaging in sexually explicit conduct.

2. Each book contains obscene images, with one book containing images of bestiality, including images of sex between a male pig and a minor human female, and images of a minor human female engaging in oral and genital intercourse with a male dog.

3. These books were delivered to and then recovered from the defendant on May 18, 2006.

4. A valid federal search warrant was executed at the defendant's home on May 18, 2006.

5. Numerous other obscene materials were recovered during the execution of the search warrant and retained by the government.

6. The seven intercepted books contained obscene visual representations of the sexual abuse of children, in violation of 18 U.S.C. § 1466A(b) and § 1461.

7. Other books and materials seized and retained by the government were obscene within the meaning of § 1466A(b) and § 1461.

They delivered them as bait for a search warrant? That's pretty low.

In my country they tell you they intercepted it and ask if you would like to pick it up. So long as you don't pick it up they can't charge you.

If you plead guilty you "may" get a reduced sentence.

What actually happens is the prosecutor makes a plea bargain with the defendant that would drop a few charges/get them charged for a lesser crime if they accept in return for shorter trial, ensured victory, and less money spent overall.

Actually, they ARE trained to shoot to non-vital places unless they are deemed to be a threat to the officers or others lives.

If you go at them with a knife, you are going to either get kneecapped or tased. Depending on how sudden it was, and whether the officer is feeling kind or not. You'd need at least a gun and would have to fire a few shots to reliably be considered shoot to kill. Even then, depending on the country and even officer, you could still be taken out non-lethally.

But of course, they can also do shit like that video and then later rule it as "legally justified" even though they were in no immediate danger.

Look, the whole knife thing won't work. They would simply have far too much time while you are rushing them unless you were really close. You would need something to make them think their life is in danger. Also don't stab some innocent person just to suicide by cop.

Get a gun and just shoot near them. Make them think you are shooting at them, but purposely avoid actually hitting them or anyone else because that'd be a bad thing.
