Individuals are allowed to get away with it because most publishers understand it is free promotion of the game. Some literal who with pocket change who can cling to "fair use" or simply doesn't make a big enough splash to be noticed is a small fry and wouldn't be worth going after. They will maybe get hit with the occasional DMCA takedown, but everybody suffers from that shit because no platform handles DMCA in an even remotely sensible way (hence an overwhelming fuckton of false claims every day).

It is the stipulation that Holos are employees of Cover, and a cut of their Superchat profits go to the company which causes this issue. The exchange of money to a corporation by using another corporation's property can be seen as a much more serious copyright infringement, so they need to agree to shit. This is actually no different in the west, if you see some late night talk show host playing Fortnite or whatever on Late Night With Big Dipshit, they got those permissions in advance.
Copyright lawyers (especially Japanese ones) are super stingy in this age of transformative mediums and the paradigm shift from television to the internet - they don't care about the internet environment and will descend upon someone like falcons over copyright if there's money to be made.
