Just because an act isn't prosecuted, it doesn't mean it's not illegal according to the law. In the case of loli, the US doesn't prosecute for loli because it's only 2D and they have more than enough crime to keep them busy. The pedo scare only grows worse as time goes on, and it's only a matter of time before they start seriously prosecuting for 2D.

The CPPA was struck down in 2002. The PROTECT act was enacted in 2003 to replace it, and it's still in effect to this day. It "Prohibits drawings, sculptures, and pictures of such drawings and sculptures depicting minors in actions or situations that meet the Miller test of being obscene, OR are engaged in sex acts that are deemed to meet the same obscene condition. The law does not explicitly state that images of fictional beings who appear to be under 18 engaged in sexual acts that are not deemed to be obscene are rendered illegal in and of their own condition (illustration of sex of fictional minors)." One thing to always consider is that anything considered obscene IS NOT CONSIDERED FREE SPEECH. This is where loli gets fucked over, because while artistic loli is free speech, loli not protected by free speech is simply child porn in the US. And I don't really think "Raped by my Older Brother -it hurts but it also feels good-" will pass the Miller test.

They check at random (though with bias, all DVD-shaped things I order are always checked in the Netherlands because they're likely to be worth enough for extra charges).
