When I woke up there was a sack on my head I couldn't see anly thing, I then heard foot steps and the next thing I new the sack was pulled off I noticed I was completely naked and tied down. It's NOT an american law, it is an international treaty. As such, it takes precedence over court precedents. Read the nicely written article at Wikipedia. Unlike DMCA which is reactive, parts of ACTA are pro-active in that they may take place BEFORE a violation has occurred once "trouble spots" have been identified. As for non-treaty nations, sure, you can still host pirate stuff there, but once an ISP or set of addresses with a pirate (dynamic IP) on them is identified, member nations will drop packets from those. This will indirectly compel that ISP to kick off the pirate user(s) in order to preserve internet access for its other legit customers because an ISP that is losing a lot of packets on the internet will be in poor competitive shape. There are MANY other aspects of ACTA of course.

ACTA was initially developed by the business-friendly Bush administration with industry lobbyist support officially sought as an integral source. It was then floated to Japan with most other major nations signing on such as canada, the EU, korea, etc. It is anticipated that that nations that did not sign on will be compelled to at least police their ISPs better because non-member country ISP with an identified pirate user(s) on it will have their packets dropped by all ACTA members (sort of like a great firewall for planet earth). You can remain independent of ACTA, but life will get harder and harder as more countries sign up and implement the "great firewall". Pretty soon, most of your international packets will be dropped simply because they will sooner or later have to transit thru a router that is controlled by an ACTA member.
