If I'm correct I believe Ufotable did not ask ZUN for explicit permission to use his characters for the OVA. I also think ZUN might've not wanted people to get the wrong idea and consider it 'official' since Ufotable is a recognized animation studio, I assume that he was alot less lenient back then.

You would imagine they would after a literal decade but there hasn't been any effort on their part to release it. I have read that they claimed that a DVD would come out for it in 2011 or 2015 but the bastards never came through with it.
I would imagine that ZUN would be more forgiving by now, since Touhou Cannonball is a thing and whatnot, so why the continued hangup?
