Not sure about the laws, but japanese society's well known quirks (Resistance to changes, stuborness but often at the same time avoidance of direct conflict) often lead to some retared or disastrous results, but some other times lead to some creative solutions like this one.
The highway was done, the building dind't have to be demolished, it also seems that it doesnt affect the other floors of the building as actually the highway doesn't touch the building itself (can confim, I was there, I took the pic), also, the building owner gets a compensation, as the higway has the 2 or 3 floors rented... Instead, if the building had been demolished, they would have had to pay much more...
On top of that, you could also say the place is somewhat of a tourist atraction/ interesting sight to say the least.
So it's a win/win/win in this case imho
