They have been shut down before and they will be.
The hosting agencies that care about not having copyrighted material being illegally uploaded on their servers will make it clear in their Terms & Conditions.
Evidently the ones those pirates chose do not care that much, but in the eyes of the law this doesn't make it any less of a copyright infringement.

But aside from that, the real irony is how selective he is in choosing what constitutes a theft and what does not.
Apparently owning the scans of a photobook (which is copyrighted material) makes him feel like a criminal yet downloading and freely distributing thousands of scans of trading cards (which is also copyrighted material) does not.

Since he apparently seems comfortable with the latter, it's evident he subconsciously wants to torrent them. Just let the man do it and don't try to bend him to your will with your cheap guilt-tripping.
As said before, if you are so eager to give more money to H!P you can always buy an extra copy yourself.
