Selling nude shoots and porn with "previously AKB girl gone wild" marketing vs. having troublesome personal life are really different things. It's not like they can sue Atsuko for fulfilling her legal right to drink as an adult individual, or Sashiko for being a teenager doing teenager things. If they had defamed AKB in some way while at it (let's say, Atsuko gives a drunken interview where she trashes AKB, or Sasshi would sell slutty pictures and associate that with AKB) then it could be different.

Also, AKB management has a reason to depict Atsuko & Rino as success stories, a not-so-popular 1st gen years after her graduation not so much.
