I think it's still statutory rape if the victim is underage (not an adult in legal terms but still able to consent). Age of consent doesn't always coincide because the term is used both for sex consent and any other type of consent that would normally require you being an adult. It's indeed automatically rape if the victim is below the age of consent (in sexual terms) but anything after that is in a grey area depending on your country jurisdiction.
