Technically, just the WebUI's and other assorted software is open sourced.
The AI model itself isn't "code" in the usual sense, it's a binary blob, it doesn't have a source code, and it's trained on copyrighted material which MAY OR MAY NOT make it piracy. (That's an ongoing debate which will be decided in courts)

The source code to train a model is open source, and the model itself is released under a very permissive license "CreativeML Open RAIL-M". But even if it wasn't the code isn't that crazy, someone sufficiently smart can figure it out by reading OpenAIs papers which are publicly available. So even if the phrase "cat bag etc." is overused, it very much applies.
