is this considered Heavily referencing your work since you're basically taking a famous picture and redrawing it in your own style
or tracing?

Usually to call it tracing the lines have to be one over the other but nowdays it's easy to move them with tools and make it look a little different without hurting the nature of the pose

I would describe heavy referencing as taking a large amount of reference from one source only, you can take a guess where's the artist stole it from. But it's not the same as making fanart or creating alternate version of an existing character. Example would be superhero characters in foreign comic who's just color palette swap Superman with additional accessories.
This one is closer to tracing or redraw, and the big problem would be when the artist claim it's not traced or refuse to put the original image for comparison. That would mean the artist indirectly saying the design and/or composition of his work is completely his own idea.
