3138835 No.3138835 [Reply] [Original]

How do you protect yourself from scumbags like this? A popular deviantart artist is accusing someone of "stealing" her work, but the work itself is a study of a famous model. She refuses to believe the other person just happened to use the same reference, and has sent her army of cucks after them to spam their pages calling them a thief.

As someone with fewer followers to combat that, what do you even do when you're being falsely accused of something by an artist with bigger influence?

Learn to give proper attribution. If it's a study of another painting, write "after (original artist/work)" on it. If it's a study of a photo, link to it.

Copying isn't a crime, but failing to give attribution is poor form and misrepresentation.

Well technically in most cases it is, including photos you didn't take yourself and didn't pay for the license to use.

Just depends on if the original author has the money and willingness to sue.

Stand your ground and show proof.
When you're going against bigger artists, it can be really hard (or impossible) to get them to truly acknowledge what they did. Even worse, their shitty fans always come crawling to your doorstep trying to stir up shit and whiteknight them. (Or worse, worse they might be selling the copycatted pic.) Keeping your mouth shut might seem to be the better option, but artists that are dense enough to post copied images have more than one skeleton in their closet.
If you are a big-name artist, it's important to be aware of the impact you have by opening posting copied work. There's nothing wrong with studying the techniques of other artists, but please don't do this shit in the open for everyone to see.

At first I wasn't convinced, but look at the reference photo. The "copied" art uses the same reflected light shape in her eyes as the "original", instead of using the same shape as the reference.

The artist copied the person's art, not the photo.

You're wrong OP. You're all fucking wrong. Only I am right. I am God. Worship me.

Technically, no it isn't.

There's a general concept in law that the courts "do not trifle with trivial matters." A study of someone's painting or photograph would be a trivial matter. Also don't forget that a study is inherently an academic exercise, as is posting it to invite critique.

This is why studies should always be labelled as such.

ayyasap made it very clear her art was a study. art__yuyu on the other hand did not. If you try putting either one's art and overlay it on to the original image, neither of them line up. However if you line up yuyu's to ayya it does in fact line up quite well. (If you ignore the image being flipped and hair color change to hide it was a traced image of a study). This is honestly laughable, just look up art__yuyu on instagram. They have a history of blatant tracing and paintovers. Their works constantly change in qaulity and look like absolute shit. Even in the image you originally posted it's obvious she painted over and edited ayya's work. If you can't tell they simply sharpened and changed the hue of the lip shine you are severely autistic. Ayya was right on this one, too bad she retracted her claims because some Russian slag tried pretending her work was completely independent from hers even though her drawing looks nothing like a study of the reference picture, but a direct rip from ayya's (which her study has stark differences from the reference picture)
