Serious answer:

If they are famous and the work is well know, then they could get in legal trouble. A popular example is Shepard Fairey, who was accused of tracing a photographers shot of Obama for his iconic 'HOPE' poster.

For everyone else, no body cares. At all.

They lose all fame and fall off the face of the earth. A good example is kr0n.

That was clearly a lie. It's also sad that most of the people on DA who claim that drawing fanart is stealing draw and sell fanart themselves. There is also a ton of art posted that clearly came from other websit3s, but people still fave it anyway. Everyone there is a hypocrite and a shit starter and alot make shitty digital stamps. I'm SOOO glad I left that site, it's imploding on itself now, as they are now trying to make DA into facebook and people are getting banned for petty and horrible reasons even though there is still art theft, trolling and drama. I'll be jumping for joy the day DA gets shut down.

They're out-casted. If their real name is known they will be blacklisted by companies.
If they just used an alias they're only option is to go off the radar until they're art style has changed enough and then go back with a different name.
