2466729 No.2466729 [Reply] [Original]

I live off a major highway and fucking tourists keep using my driveway to turn around. Someone just drove right up to the house in order to do so. How do I deter these fucks without having to put up a gate. I don't want:
>signs
>gate (looks really impersonal)
>steel hedgehogs or similar items
>to wreck their vehicles (illegal where I am)

>I don't want:

A gate you like the looks of, maybe wrought iron instead of a cattle gate, is really the way to go, but yould try
>Nasty speed bumps, a dip, or those removable poles they use in parks and the like
>Parallel parking your truck at the entrance
>Buckets of imitation crab meat
You basically need something to physically impede ingress because a sign wouldn't do anything even if you wanted one.

Most roadway pavement sections are quite a bit thicker than driveway pavements, because a driveway is only intended to have the owner's and his guests' vehicles on it. Add to that turning a vehicle around puts more stress (particularly where the tires turn) on the pavement than just driving through, and depending on how much traffic goes in and out of his driveway, it can indeed cause him to have to replace it earlier than otherwise would have been necessary.
If OP wants a more passive approach, he may want to consider taking the end of the drive and putting grasspavers (https://www.invisiblestructures.com/products/grasspave-2/ or similar) instead of asphalt. It can still be driven on, but it doesn't look like a route that can be driven on.

Do they make a turn at the road or the house?
If they turn at the road, placing bollards (or rocks/boulders) of similar size would greatly encroach on the turning space and definitively keep them off the grass. But they would look natural and not impede driving up the drive way. Which might lead to them turning at the house, so might need picrel, it folds down and isn't as visible as a whole gate

its not up to a homeowner to make up for missing signs on roads. thats up to the city. fuck those "tourists" they can get fucked. you should know better than to use someones private property to make a U turn or to turn around to go back in the other direction.

>city should fix the roads then,

Nothing wrong with the roads or the signs or anything. Sometimes people have to turn around. And if your or OP's driveway cannot survive a vehicle pulling in briefly then you should fix your driveway. I know I've turned around in lots of driveways, and except for the time I knocked a planter over I've never damaged anything. So don't leave gay-assed planters 3 inches from your driveway.

>private property doesn't trump ease of access.
Ease of access is a term usually used for handicap accessibility, not traffic turnarounds.
That aside, in this case it does. If people were traveling across his property for a legitimate purpose -- accessing something that his property blocks from the roadway, for instance -- then in that case there would be cause for an access easement to exist. This is not the case here, as this is because retards are too stupid to realize that they got off at the wrong exit. Or, more likely, they know exactly where they wanted to go but don't want to go the extra mile to the legal U-turn on a divided highway and are using this as a form of shortcut. Neither one is a legitimate cause for access across his property.
If people were staying in the right-of-way, then while it's a dick move to be using his drive apron for a turnaround, there's nothing that's particularly illegal about it. Coming up practically to his house, however? Unless the OP picture is the most fish-eyed camera in the world, that would clearly be trespassing at that point and he has every reason to demand it stop.
Speaking from a municipal standpoint, we don't want people turning around in other peoples' driveways, either. That's not what those driveways are there for, and fielding calls on that kind of shit makes us have to do work.

check out "Premises Liability"
This is the whole point of liability insurance, you can be sued even if someone falls on your sidewalk - in reference to even trespassers
"With respect to trespassers, if the owner knows that it is likely trespassers will enter the property, he or she may have a duty to give reasonable warning to prevent injury. This requirement applies only with respect to artificial conditions that the owner has created or maintains, and knows may be likely to cause serious injury or death."
Obviously this varies location to location... same reason you obligated to clear ice from your pathways in the winter, pretty sure even the USPS can sue you for fault due to a fall injury anywhere on your property

Okay, checked it out, if he posts "private property, no trespassing" then he's pretty much covered for liability, assuming he doesn't know they are on house property. If he does know they're on his property then he has to warn them of dangers, but that's it, then it's on them. As you said, this varies by location, but this is what I'm reading. And in Ohio where I live, the state supreme court had even ruled that the property owner isn't liable for an uncleared sidewalk, so sorry if you live somewhere that you can be sued for that.

Speed bump, a MUST for this(hard to argue they didn't know they trespassed when even a truck rocks HARD going over it)Easy to install/make legally.

Fake spike strip is a no-go. Idiots will purposefully try to pop their tires to try to get free tires via insurance, even get out of their vehicles and pop them with their own screw drivers and argue the rubber spikes did it.

Get a NASTY(aka sharp/substantial looking/aka ruines a vehicle appearing) METAL FENCE. Install a gate that auto-opens when a transmitter/registered cell phone comes to it(limited entry for clients(they'll like this, makes them feel special, unless they hate tech/cellphones)

Horn/flashing lights not a good idea, insurance scammers LOVE THEM. Buuu, but h'your 'onor, the loud noise/flashing lights blinded/surprised me and I crashed my vehicle, their insurance should cover it, I'll end up on the streetz.

Also getting your local cops to patrol your area for speeders will instantly get you browny points with almost any police department. Especially if the speeders aren't local(outside money, locals happy about outsiders not messing around your neighborhood, etc) also MAY get local law enforcement to scare off/fine trespassers with no lawful entry reasons. Or get yourself ticketed all the time for speeding home.
