1879686 No.1879686 [Reply] [Original]

Every wall in my house has these stains that have started popping up as of a year ago.

The building manager (office clerk) says that it’s because of the humidity so it’s my responsibility. I say it’s because the unit above us flooded.

The stains are on the walls anywhere from 3 inches to 2 feet down.
I’m not an expert on this though, can you guys give me an opinion?

That's not humidity. That's some serious leakage. Or possibly entities from another realm coming to get you.

>> No.1879708

it is a humidity problem

the unit above you had 100% humidity

I had the building manager come in actually a few minutes ago and he himself and say that it was because when I painted the walls I used too much paint and it was dripping down.

Does that sound like a possibility?

That's flood damage. Stop paying your rent until it's fixed. You have the right to do this in the US. You may have to notify your landlord of the reason, so do some googling, but you have a right, rather than merely a privilege, to have your rental property kept properly maintained.

He can't change the locks or threaten you. Make sure you record any conversations.

>> No.1879826

Lol, that’s not humidity or a bad paint job. That’s staining from a water leak. Something spilled or leaked above you and it stained the drywall and paint. If it’s not wet and moldy it was probably fixed immediately and no longer poses a risk as far as mold goes. Have you went upstairs and asked the unit above you if they had a leak or water related incident around the time the stain appeared?

PS, if it was due to high humidity in your unit, you would have noticed the extreme humidity and more than likely would have had some major issues with your AC system.

Unfortunately I live in an area where it’s illegal to withhold rent, Id have to pay the rent and then apply for a rent refund if the landlord council sees that I got fucked

Yeah the apartment above me flooded 5 times in the last 2 years. Just a bunch of fucking kids.

So they’re basically coming to paint over the stuff. They’re trying to push the narrative that it’s because I did a botched paint job. They might try to make me pay for it but I’ll just tell them to fight me in court.

For the anons who said there might be mold;; I know painting over the mold doesn’t kill it but if I’m leaving in 3-4 months anyway, will if atleast help out?

>>1879920

Anecdotally I can tell you that you will prob be fine re: the mold if its only a few months, I'd be more concerned about making sure you have enough pictures of the stains and documentation of your interactions with landlord just in case they try to fuck you by charging you for the repaint, though I doubt they will. You should also seriously consider reporting it to the landlord council you mentioned before cos it could be a genuine health hazard for the next tenant, though I'd maybe wait to move out before reporting it.

If they paint over it before it's established what it actually is you will pay for it. Probably twice, because if this is how they're treating you now, you sure as hell aren't getting any deposit back. The guys coming to paint are almost certainly the building manager's buddies.

I called my city’s bylaw and got connected with a property standards officer.

He told me no contractor could look at that and make the decision that it was from a paint job.

He basically told me to refuse the debt and tell them to take me to small claims court if they want their money.

>>1880088
Yeah absolutely the contractor and the manager are buddies. The contractor lied and is basically saying whatever the manager wants to hear.

Guy's a retarded cunt and clearly thinks you are too. Paint runs will be apparent immediately, not years after the fact, and will be the same color as the paint that was used not an off shade. Punch him in the dick for being a fuckface the next time you see him.

>>1879916
>looks like a leak
>apartment above flooded FIVE TIMES

It's very obviously damage from the leak above. Forget my previous advice; punch your building manager in the dick a hundred times, then another thousand, and then keep punching him in the dick until it has been pounded within the Schwartzchild radius and punch one more time for good measure. What an asshole. In the meantime document everything and prepare to lawyer up because you're 100% about to get fucked.

Basically it's a building management company who said they didn't have enough $ in the budget to hire someone to paint the walls, so they gave me a bucket of paint and let me do it myself.

Update:

A lawyer from the legal clinic called me back, they said that they have to file an application and serve me a notice where I either 'pay up or get evicted', and that I don't have to do anything before seeing a rental judge, which would take 1 yr+

So they might try to use the notice to bully me into paying or paying a discount but that I can tell them to go fuck themselves and the lawyer will represent me in court if it escalates to court.

Still haven't heard anything from the building manager so I'm hoping they'll fuck right off.

Sorry this is happening to you OP, but this right here is EXACTLY why this board just fucking rails on anyone who does work to an apartment or rental house. And rightfully so.

Its not your property, its not your responsibility, if you rented a place thats utter trash its your fault.
You are putting effort into someone elses property so that it is more liveable, AKA you are spending time and money to convince yourself to stay paying rent in a shitty place longer.
Use how shitty the place is as a reminder you arent where you want to be in life, use that energy towards saving for a real house. Its really not that hard to get a home loan if you have any job better than minimum wage.
People get asshurt about it when you tell them to stop being stupid, but here is a real life situation where liability came back to bite OP in the ass.
Fuck slumlords, fuck renting. If you have to buy a shitty one bedroom foreclosed house, you are STILL better off than renting.
