Assumptions based on a few paragraphs of text, not that her being happy with her mother is any sort of argument either way.

Irrelevant all of it.
I just said that taking custody away from the father doesn't sit right with me. I am generally speaknig in favour of mixed custody and then letting the child decide as it gets older.
Point here is that some third party thinks he has right to not only become this girls father because he's happening to bone her mother, but also to deny the actual father from having an active part in her life.

Come back to me if you can prove that the father is violent or an addict, if not I'll consider this argument over.

This argument is far from over. I remember he past thread and the step father and mother had custody from day 1 of the divorce. The little girl loved her step father and mother, and is miserable with the birth father because he is a lazy shit and doesnt cook anything, which is why is became relevant. OP had been her stand in father for long enough that it causes them both separation pains. You werent in the original thread. and i'll bet my savings that you are the birth father in question from how defensive you are
