It's because they didn't have the signs up at some locations warning about the caffeine levels, and many of the employees didn't know either, even suggesting it for children under 5 years old.

Further, lemonade is not a drink commonly associated with caffeine, had they marketed it as an energy drink with lemon flavor, that would be different. They also put the charged lemonades RIGHT where the normal tea/lemonade stand used to sit next to the regular soft drinks, totally separate from the coffee station (where most of the highly caffeinated beverages are)

Also the fact they've lowered the caffeine amount by almost half, and put up even more obvious signage (with some stores removing them from the floor and putting them behind the counter) shows Panera knows they've fucked up and they're trying to rectify shit.

2) Regardless of the loss, other businesses will start protecting themselves. Gas stations and diners will remove self-service stations and prohibit refills entirely.
3) Assholes will still try to poke holes in the system, seeking energy drinks as the next lottery ticket; drink enough and you'll eventually win!
4) Laws will be eventually enforced to prohibit sales of any caffeine product without an ID.

Basically, it's all a giant fucked up arms race where a few idiots will push the limits of stupidity so far that the businesses will just respond by removing any and all opportunities for a law suit.

Paneras is the exception. Businesses aren't going to go through the nuance of deciding which drinks are safe to give away for free. They'll just remove the option to consume more than the initial payment altogether. Because that is the fastest and easiest solution that allows them to still sell coffee without worrying about someone chugging it for that sweet, sweet lawsuit bankroll.
