The other one that keeps getting people's jimmies rustled are cucumbers - its cousins in the melon section are considered fruits and the squash/pumpkin section are considered vegetables.

Botanically speaking a fruit produced from angiosperms are a group of ovaries with seeds inside (really watered down definition) so yes, it's a fruit.

In terms of it being a "fruit" like an apple or orange, I still consider it more of a vegetable.

In a culinary context, it is often used more like a vegetable. It all depends how you're going to use it. Since this is a cooking board the answer is vegetable. In /an/, /sci/ it would be a fruit, a berry.

There was a late 1890s Supreme Court decision on whether tomato was a fruit or vegetable.

It made it that far because some sneaky guy was importing tomatoes and the taxes (or teriffs or whatever) were different if you were importing a fruit or vegetable. The guy argued that tomato was a fruit, but the government said it was taxed as a vegetable and has always been taxed as a vegetable. So it made it to the supreme court.

And the court ruled that it was indeed a fruit, but for the purposes of taxes, the government considered it a vegetable

My father lived like a king in communist Poland in the 80s because he had a house outside the city with a big garden, he could grow his own shit and more importantly he could have space for rabbits which were in high demand due to scarcity of meat. "Fruit" and "vegetable" can both be identified by botanic definitions though. Fruit is, like you said, ovary of the plant, whereas a vegetable is a plant itself. A tomato is a fruit, if the plant the tomato grew from were edible then the tomato plant would be a vegetable. The people who make up categories for these things don't have any reasoning for why they put something in one category, it's just "I feel like it's a vegetable"
