It's a question of expectations. Take coffee from 99% of restaurants, truck stops, convenience stores, and fast food chains. Spill some on your skin, it hurts because it is hot, just as expected.

McDonald's coffee is confirmed (you can google this) to have inordinately high temperatures which are not even close to industry standard coffee serving temperatures. Think it's no big deal? Go down to your local McDonalds tomorrow morning and slowly pour a 20 oz coffee on your hand. Most other places will be like "ouch that hurts", just as you would expect. McDonalds, you're likely to get severe blisters. Not what you would expect.

They've basically admitted they'll pay for lawsuits because their analysts have calculated that their customers like coffee to be much hotter than average. You can also look this up.

If they had a label that said "warning our coffee is much hotter than any other coffee" it would be one thing. But when people say coffee is hot, common sense suggests dismissing the warning because normal coffee hot isn't dangerous, like McDonalds coffee is.

A hot drink is just a drink that is hot. My point is that you can meet the technical definition perfectly, and still find ways to fuck someone over based on reasonable expectations. It is not normal to handle coffee as though it was capable of causing third degree burns.

To use another example, I keep my kitchen knives sharp. Like, really fucking sharp. I use a progression of japanese waterstones and finish on a chromium oxide hanging strop. If you handle them like typical household kitchen knives, you will end up in the hospital and probably require a few stitches, if not worse.

It would be funny if I just said "haha they're sharp be careful" but all knives are sharp to a degree, and the consequences of being misunderstood are pretty serious. For this reason I physically stop my house guests from handling my knives until I have taken steps to verify that they understand what that really means.

It is McDonalds's fault because they failed to take extraordinary steps to warn people, despite creating an extraordinary situation with their coffee. Just saying "it's hot" is insufficient because it will be misunderstood by most people.
