400mg is a lot of caffeine, drinks with way less than that have warning on them already and for good reason. Bang wanted to be 357mg when they launched by had the foresight to throttle back to 300mg. You can't stop people from eating or drinking too much of whatever you sell but you can certainly minimize the risk to individuals by including warnings and controlling for serving size.

interesting
so the lawsuit is saying the Panera Charged Lemonade was presented similarly to gatorade, and the text on the menu shows "as much caffeine as our dark roast coffee"
which the lawsuit is saying is misleading, the girl didn't avoid caffeine altogether, just highly caffeinated energy drinks(with all the additive shit that goes along with it)
also, their dark roast coffee doesn't contain anywhere NEAR that amount of caffeine or sugar or additives
this actually seems like they have a pretty good case due to panera outright lying about caffeine content
you shouldn't need to dissect the nutritonal info for every beverage option on a menu to find out if it contains a heart exploding amount of caffeine

Caffeine gets me the first sip. And I have a pretty high tolerance too.
I do agree with you though putting the shit in lemonade does feel a bit deceitful, when it's expected you would drink the entire thing. Usually, a Bang's which has 300 mg takes me at least the entire day to drink, but usually I drino it over the course of two days. I can't imagine slamming one over the course of a meal, but anyone would if it were marketed as lemonade.
Plus, Bang's is one of the higher caffeine energy drinks, normal monster has 160, and I know some that have 80. I think coca cola is something around 30 mg, which is probably what one would expect from this charged lemonade

>Ask anyone who regularly drinks coffee to go without it for a day and watch the crash, you tell me if it's bad for you.
I drink caffeine from time to time because I'm an iced tea and milky iced coffee fiend, sometimes abuse it if I'm doing long term fasting for the variety but if I drink caffeine regularly for like 4 or more days I feel fucking miserable whenever I'm not taking it.
I've worked with caffeine addicts over the years and laughed it off but the crash from caffeine hits hard and fast compared to some of the other legal drugs like nicotine & alcohol. You have to abuse alcohol hard and fast to the point you'll be shitting your guts out with hemorrhoids long before you'll see the withdrawal symptoms kick in and feel like shit from withdrawal in any way. Meanwhile caffeine can take as little as a few days of sustained use to creep up on you.
>The only reason it's socially acceptable is because it helps employees keep working and isn't as bad as some of the more addictive stuff.
-And this part's the truth. Especially the first part. Being a stimulant rather than a depressant helps a lot.
It's perceived as less fatal because you have to work hard and be a darwin award candidate to meet your end to it.
Nobody is out there dying from 4 cups of coffee a day or steadily increasing their intake. Meanwhile nicotine is associated with good ol' lung & throat cancer and Alcohol has liver disease & Wernicke-korsakoff in the wings. Employers & corporations don't mind if you're a bit grouchy, crash or have a headache from not getting caffeine, why the break room's right over there. They do care if you're needing to take time off to chug down a nice ice cold beer though or standing outside smoking (negatively impacting the image of the business) reeking of an ash tray.
