But if you opened a hot dog place in a food court and the owner of a place that sells subs sued the court owner wanting you shut down because the contract said one sandwich shop, you’d probably be allowed to stay because there’s a narrower category of sandwiches that excludes certain types of “atypical” sandwiches.

Burritos and döners and gyros and shawarmas and hot dogs and hamburgers are all sandwiches but they are atypical sandwiches. When we say “I’m getting a sandwich” from a restaurant we mean usually a place that sells a food item on bread rolls (sometimes sliced bread) with sliced luncheon meat and vegetables in between. The luncheon meat is cooked and usually stored cold (exception: nice delis keep pastrami and smoked meat and corned beef brisket steaming).

So my answer is that while a hot dog is a sandwich, you would not call a place that sells only hot dogs a sandwich shop. People generally specific the category of sandwich with atypical sandwiches like hot dogs.

Why? Because it’s only one continuous piece of bread? Subway cuts open a large roll but it doesn’t cut the bread in two. Many sandwich shops do this. A hot dog only has like sixty degrees of exposure, not 180° like an open faced sandwich.
