Jersey Mike's isn't super cheap, but it's not ridiculously expensive for what you get, and what you get is a hell of a lot better than Jimmy John's. I have been to Jimmy John's a half dozen times in my life, and it's ranged from garbage to "meh," and never higher. It's Subway tier, lower in my opinion, with poor variety, and somehow they charge you significantly more. I just don't get it.

I have no idea. What's your point here? That they should've been convicted for the allegations in the lawsuit magically before the lawsuit even existed? Also this doesn't seem like a special situation only applicable to Jimmy Johns. McDonalds had the same sort of class action lawsuit filed against them for wage theft. That's exactly what's supposed to happen with salaried pay though. The entire point of hourly vs. salary is FLSA exempt status. And if you're FLSA exempt you don't get paid overtime. Not everyone wants to be paid overtime either when it's a choice between a few extra bucks of OT vs. not needing to be constantly time tracked like you're some grade school child with an attendance record. I'm seeing giant bread, stacks of space-wasting lettuce on literally every single cold sub, and very little meat. Calling it "pay theft" is sensationalist bullshit.
What they're really referring to is making use of salaried employees instead of hourly employees to cover extra hours. In the US at least, there's a law about "white collar exemptions" to overtime pay, where if you're a salaried professional then your employer doesn't pay you overtime. Which makes sense because that's the point of salary, you get the same check every couple weeks or at whatever interval your payroll runs with regardless of if you're there 20 hours that week or 80 hours that week. You're just on salary, not getting tracked and paid down to the hour like a "blue collar" wage worker.
Where the controversy comes into play is whether assistant managers at a fast food chain who are making little more than minimum wage should really be made salaried. The Obama Administration tried to pass an update to these policies about overtime pay a couple years back that would have added a minimum pay rate requirement, so as an employer you would be forced to choose between paying your salaried workers at least 48K / year or else downgrading them to hourly status. And if these fast food places downgraded their assistant managers to hourly status then they would be obligated to pay them for all that overtime accrued since they'd now be tracking all their time worked. The updated rule came very close to getting passed but was shut down by a federal court at the last minute (and actually a lot of businesses had already either downgraded their low income salaried workers to hourly and/or bumped up the pay of their borderline income salaried workers to get in compliance ahead of time).
So tl;dr no literal theft took place at these Jimmy Johns restaurants, they were only doing what a million other workplaces have done both in and outside of the food service industry, which is make use of salaried status to get staffing covered without needing to pay as much since salaried workers aren't entitled to overtime pay.

It's not about blaming employees for doing a bad job working, it's about blaming employees for voluntarily putting themselves into a salaried work agreement and then turning around and complaining that they don't like it. It's like that scene in the Austin Powers movie where the guy gets ran over by a very slow moving steamroller. That's how I imagine these workers who feel victimized by this, because it's not like it would be some sudden unexpected surprise that they made less money compared to if they had been paid overtime. Of course I'm pretty sure none of these workers really felt victimized or caught by surprise by any of this, they're just looking to cash in on some opportunistic parasitic law firm's offer to steal lots of easy money from their evil bosses.
