As much as I despise chefs from having worked with them, he's right in this case.
Eating that sand is on the same level as eating the shells.
Our general rule was that anything you put on the plate, that people might reasonably eat, should be edible. I.e. don't garnish with a poisonous plant or shit like that.
But if you're serving something like scallops or oysters on the shell it really is up to the guest to not be retarded enough to chew the whole thing, or in most cases whatever you put under the shell to stabilise it. (pebbles, empty mussel shells etc.)
