If you are going to cosplay as a semi nude character, its logical to cover yourself up in a manner that allows you to still walk around in public just incase a part of the costume breaks.

This could have been avoided if just a little thought had gone into the underwear of the costume, but instead the wearer decided to go for comfort rather than safety.

Is it okay to do this? No. But people get a little weird around costumes in general, and at conventions where drugs/alcohol/lack of sleep can come into play, many people make poor decisions. As a cosplayer you need to expect that someone will touch your costume and be prepared for it (have a handler, make sure things are secure, guard your prop from being grabbed).

Flipping up the front flap is something really extreme and I am glad the guy got in trouble for it... but not wearing underwear? There isn't any pants or material to prevent your vag from getting all over. That's gross and a poor choice on the cosplayer's part.
