To your point on same sex marriage, this is likely because since the majority of people getting married have been cis and being trans is not the norm in the English speaking western societies who first approved or discussed same sex marriage, and because gender discourse wasn't as far along and commonly dicusses as it is now back then, people just used sex interchangeably with gender even though it wasn't technically accurate.
