The PoW coins do not need to be registered (generally). All of the coins that had a ICO (yes including ETH) fit into the Howey test, making them securities. The Law was made in '33 so crypto will not be 'grandfathered in'. And even though I agree with your assertion that ETH and its bastards fall under securities, I don't think they are going to be categorized as such any time soon. At least not before Coinbase gets the clearance and becomes a total monopolist. Then, maybe.
Sec will declare these coins/tokens as securities when all of the interested buddies will be ready to enter this market. They are in right now, no doubt but the real shit is only starting.
Here is my tin hat variety thinking:
When the BTC shits the bed but ETH won't shit the bed as much every time that the crash happens, and also recovers faster than BTC each time, it will, with time (no idea how long) capture bigger and bigger market share. Then the flippening will happen. And then the ETH will be deemed a security.
This is of course just my thinking nothing more than that.
That would be the way to effectively control this market, by controlling the "main" coin.
And then again, I can be completely fucking wrong and have it backwards. Only time will tell.

I see the SEC wants to remain in power, controlling crypto (even if its just the ICO ones) is a great way for them to do that. The SEC wanted to control BTC @ one point but the CFTC also wanted to remain relevant & made the case (correctly) that BTC was a commodity as it required Work (part of PoW) making it a commodity.

I agree that the eth will be deemed a security, even though I kind of think it is a stretch (ICO's don't give you any kind of "right" or shares...but that may be my misunderstanding of the subject)
The control of the main coin through the team is not really a control especially if you can't use regulations (theoretically) to make sure that only "accredited investors" can have a piece of the pie.
What I'm getting at here is that the SEC is not merely seeking power and the control just because, SEC doesn't serve small fish aka plebs, they serve the buddies high up so they will make sure that the buddies are the ones who get the biggest piece of the pie in the US.
Now, how this will affect the crypto markets depends on the other governments. I personally think that they will follow suit and all but a couple will try to limit the possibilities of entry for the average Joe Shmoes.

The market so far is so tiny that it may take a while for them to decide that it is worth the trouble, but the money in this market is already real and maybe, just maybe it will happen faster than I think.
If you are right though I think I'll buy in Omni Layer and and their shit, but most importantly will keep my BTC position untouched.

My statement on the control of the team, is my observation that the lighting network was nothing close to the original idea. The lightning network brings BTC *closer* to the definition of a security, as 'of sole benefit' is with the securities explanation. BCH is the original idea. But the BCH team is supporting a fraud, Dr. Lair Face. I saw he posted some pics of securities books on his twitter recently, *my opinion* Satoshi knew securities law, hence why BTC is PoW, to keep away from the SEC. The CFTC must have been so happy to get some control away from the SEC. DESU i don't think i had heard of the CFTC before BTC...its a gov. power struggle for more funding for their dept.
