7984891 No.7984891 [Reply] [Original]

I'm in the military and at a military school. Mother unexpectedly passed away at 56 a little over 2 weeks ago. Took emergency leave to fly home as the executor of her estate. In the course of approx two long weekends, I handle 90% of everything.

Hire a contractor to replace the carpet, treat walls with chemicals, primer, paint, and a few other things. Paid for supplies up front - got an invoice with the guy's name, number, address, and his business. His business name is "All About the Detail" and the address on the invoice that he signed is McKeesport, PA.

Looks like he is going to stiff me. Trying to get him to bring the materials to my father, who I put in charge when I had to leave. Thus caught him lying about some of the work that he allegedly started. Called him out, he basically quit and said he will just give us the supplies that we paid for...but has dragged feet.

Not about the $ - it's about the principle. Not trying to play the victim card here, but this guy knows the situation and still screwed me over. I understand this happens constantly with contractors.

In the last month, grandfather passed, mom passed, wife has cancer, and even my darn dog is about to pass away after 15.5 years. After all that, factor in the fact that I can't be home like you normally would after a major death in the family and I'm trying to handle the estate as best as possible. Everyone has been helpful, but this guy knows all this and still is screwing me over.

How should I approach this situation? I'm in a sticky situation being so far away, but I am having a hard time finding info on this guy's business. I have his address which I think is his personal and his phone number, as well as his name.

Part of me really wants to find some sort of link from this guy to something official, so I can plaster all over social media, and even contact local media. You have to stoop pretty low to take advantage of a family going through that kind of madness right now.

In my country (aus) you'd send what's known as a "Letter of Demand" (templates online) with signed delivery so you know he received it. You'd outline 2 weeks for him to give what he owes. If he doesn't, you take him to small claims court. If he still doesn't show up or provide what he owes you, you can get a sherrif to escort you into his property and sieze your assets. Sometimes, if there's property in the front of his house, a sherrif will let you sieze it if it's at equivalent value of what you're owed.

If I was in your situation I'd do that. If all else fails, I would go to his place of business or home and take what I payed for, even if that means assets to an equivalent value. I'd also consider smashing a window or two, for good measure. Fuck him, he's clearly a piece of shit and betting on the fact that you just give up and let it slide.

I'm really sorry to hear of your situation OP, you seem like a really reasonable and kind guy. I truly hope all works out for you mate. Best of luck to you and particularly your wife in this time. Stay strong mate, she'll be right.

Contractor here...

I'm not a fan of the supplies up front routine. I don't do it. I make them sign a work order and I take a before and after video on my cellphone.

In 5 years 3 people tried to not pay me. I threatened all 3 with a lawsuit and all 3 paid.

In your case I hope you have this guy a check and not cash! In either case just tell him you want either the supplies or your money back within 5 business days or you will file against him in small claims court.

And if he doesn't, file.

Consider going to court a learning experience and you will feel better about it. In life you will occasionally get fucked. Part of being an adult is going to court. Just accept it.

Then go hard. Post it on social media, go to review sites and post 0 star ratings. Even better, find as many business directory sites you can and register him up to all of them. Leave reviews on every single one warning people of this scammer. Post it on any of his facebook pages, and post it on community pages (i.e. "Pittsburgh Crime Watch" or "Pensylvannia Town Hall", in my country we have super popular "have a whinge" pages, i.e. "McKeesport Have A Whinge" etc. Etc.)

File a notice to the relevant ombudsman, send an email to local TV stations about "contractor scams grieving local family". Call up radio hosts and explain the situation. Find relevant blogs on local businesses, and leave your comments.

Be sure to:
>always remain completely factual to protect yourself
>be sure to come across as reasonable and balanced, it will help your cause
>cite his full name, his full business name and website if possible
>repeat this everywhere that is relevant across the web
>the goal is to make people aware of his business and instantly associate negative stigma with it
>whenever someone searches "All About The Detail contractor" or his name, your review should be the first thing they see.

If there's a wikipedia page for your town, consider putting a "notable scams" page or something like that there. Be extremely careful in remaining factual and using measured language to protect yourself. Courts will see a reputational attack as more severe than a small unpayment for goods in unclear circumstances.

Look at sites like "Ripoff Report", "consumeraffairs.com" etc. and leave your circumstances there

I've seen contractors make websites where they say "in business for 30 years" and I know for a fact they just started 6 months ago.
