It was included as a gimmick to offset the lost tax revenues so the package could get a better 10-year score from the CBO, to make sure it could be passed in reconciliation (if I remember correctly). Like the image says, it was expected to be rolled back... but never was.
The idea was:
1. Pass the tax cuts, lower taxes immediately
2. Raise taxes on software companies 5 years in the future to make up for the loss, so the package scores better over 10 years
3. Plan to undo the raised software taxes before the 5 years come up, and thus expect a future congress to figure out how

I know it's impossible to be perfect at it but assuming SOXX is topping out around NVDA earnings, why not switch to the bear ETF if you think the underlying is going to have a leg down? Well, I'm not a tax expert, and idk if this is true, but I've read that there are other situations where you need to capitalize payroll expenses. Like, if you hire some guys to build a shed that the business will own, those wages have to be treated as capital expenses and amortized over the useful life of the shed (whatever the tax laws say it is). If you pay those same guys later to maintain the shed, that's an opex and can be expensed immediately.
The thing is building software isn't like building a shed. In very very very few cases can you build a piece of software, consider it done, and get 5 years of useful life out of it, especially for a small/young bootstrapped company still trying to get customers and grow. Every day is a combination of maintenance work and building new feature. It's impossible to distinguish the two.
If I swap the shed metaphor for a boat (and a shipping company): the shipping company hires some people (or a supplier) to build the boat (capital expense), then operates and maintains it over the useful life (opex). A software company is like paying the same people to design, build, and operate the boat at the same time. Also doing research to figure out what kind of boat they really need, and periodically tearing down their boat and building a new one. Software just isn't as stable as actual capital goods, so it doesn't make sense to treat it like one.
