OR, you leave them with a massive headache where they have to choose to bury it (really depends if you are actually valuable to them), or risk future incidents having real legal consequences for the company.

HR's job is to protect the company, NOT YOU. So make it easy for them to PROTECT THE COMPANY, which is their JOB.

You can only create a headache for them if you're valuable i.e. someone else in the company is pressuring HR not to fire you (HR doesn't act unilaterally, they just make recommendations to higher ups). If you are readily replaceable, they'll just fire you instead of pounding another two bottles of wine that night to dull their miserable slavedriver existence.

Your best option is STILL to play dumb and promise to change.

Then, you could bring it up to them several weeks later about how since the incident, you noticed her winking at you and licking her lips at you, and the first time you thought it was a mistake, but now you feel threatened and uncomfortable by her actions. Ask them to transfer you to a different team.

Now, HR is really in a pickle. They have a documented incident where you made what any reasonable person would understand as an innocent comment, and you were fully apologetic. The next incident would seem to be a kind of retaliation or instigation, and the keyword here, ***HOSTILE WORK ENVIRONMENT***. HR will not even want to investigate the incident by questioning her, because she will lose her shit completely. Now they have to find a new position for her, or new position for you, or maybe even put her on an unrelated probation because there are so many incidents pointed in her direction regardless of the facts in the matter. And they probably have to post a job position to get ready to backfill the position they're losing, if they want to keep existing project timelines, ballooning budgets for little perceptible gain. Cheaper than a lawsuit though!
