I got laid off in December from my W2 software dev job and a month ago started taking unemployment. For the past year I've also had a small side hustle (1099) with another company (maybe 10hrs a week). They have cash flow issues so they owe me a year back of payments. Last week I got a check from them for $1k dated for last July (first check since January) . How do I report this on unemployment? I have been reporting I have been doing 0 hours of work because I don't expect to get paid anytime soon which is maybe incorrect. Their language says you must report the wages when they are worked or whenever the transaction is finalized (which I consider the latter since I can't expect payment anytime soon the transaction is still open).
So do I:
>Report the $1k in one week with about 10hrs of time worked, my actual worked hours
>Report the $1k in one week with about 28hrs of time worked, the number worked to generate that income
>Spread out the $1k over 2-3 weeks with hours reflecting what I'm working this week or prior ones when generated
And should I start reporting the hours worked but $0 in revenue or just continue reporting no hours worked unless I actually get paid.

Isn't that fraud and easy to see when I not only deposit the check but do my taxes? It is income from July so before the unemployment period but that doesn't yield well to not reporting hours worked argument.

You should call the unemployment office and ask them your questions, but document EVERYTHING they say and do, write down who you're speaking to, because chances are you'll be talking to a diversity hire who will tell you all kinds of wrong shit so you need to be able to prove you were doing everything to the best of your ability and the knowledge you had

Thanks for the reassurance. I was hoping not to call them in case to draw more attention to myself but I could always call from a burner and record the conversation to document it. you realize the government could very well see your 1099 on your taxes, and then they will see your 1099-G and say "hey wait a minute..." and this could even get pulled years from now.

Your client's cash flow issues don't have ANYTHING to do with your benefits, with the DES, or the taxpayers funding these programs in the first place. The fact is you're supposed to be getting this money.

You're overthinking this $1000 dollars. unless you have told them that you make 0 dollars and work 0 hours(oh wait you did) there would be nothing fishy about you getting $1000 for hours worked. As far as I'm aware the DES in most states bases benefits off of hours worked and your hourly rate, not the paycheck you got and especially not for things outside the benefits period.
Since it sounds like you are continuing to work for them you should definitely report it. Since they are backdated a year by the time you get paid for the current hours I doubt you are gonna be on benefits anymore anyways, so maybe no one will be looking anymore... but really if it's within the year it's gonna be on your taxes otherwise you could pass it off as a big contract or something down the line.

Just be honest. You can fudge it a bit to get the benefit of the doubt. Say since they haven't been paying you for a full year's work you weren't sure you should b e reporting it or not.

I don't think that is going to matter you are going to need to talk about your specific benefits case they aren't going to talk to an anonymous random person with anonymous questions.
I really doubt anyone qualified to answer these questions is going to talk to you about it if you pretend to not be on benefits yet. Instead they are going to ask you to fill the application process and then discuss it with your case worker. So yeah, just ask your fucking case worker.

it's very easy to get flagged. I worked a one day temp gig once while on covid unemployment benefits and my wife worked one week at another gig before they decided they wanted someone else. Both times reported the hours faithfully but the agency we go through reported the income as the following week when they paid us. We got some accusatory letters. It was very easily sorted out but they still put the burden of proving it on us... was very easy with our pay stubs. Just don't fuck around with these people, it's a felony.

you'll still pay taxes on it, and at the end of the day that's all the government cares about. You left your old job in December...so you're unemployment should be running out now, right? It only lasts 6 months.

It’s a bit tricky. You might just call your UI office and ask for advice. Think about what you are going to tell them though. So you got a $1000 check for work you did last year? Maybe just tell them that, and not that you’re working now. If you get a check for work you did recently, then you need to report it if you want to not commit fraud. If they catch you they’ll make you pay back all your benefits.
