oh really? Because last time I bought AVAX it went to my wallet controlled by my private keys, where I staked it via the protocol to secure the network which is operated by 1200+ geographically distributed validators, 70%+ of which are hardware nodes. I also used some to pay gas fees to utilize the network for smart contract computation. None of these actions were reliant on continued effort by avalabs, the network already exists and is functional. If avalabs blinked out of existence none of the above would change.

the network was functional upon mainnet with no further effort from avalabs. AVAX could be used to stake and secure the network as well as purchasing computation from the network of permissionless validators at that point in time, which is the purpose of the token. Just because there's currently 1 client and validators trust that client to be in the best interest of the network does not mean that avalabs controls the network or has any sort of actual authority over it. Appreciation in token price does not depend on effort of a single party specifically and is also not the function of the token.

the operation of the network requires no input from avalabs. They can introduce new features, bug fixes, etc. but it's permissionless and autonomous at this point. The do not decide who gets to run a node, what smart contracts are created, who gets to use the network, how transactions are ordered etc. At this time they own a significant minority of the stake, but it's certainly less than the 80% safety threshold.

However, if you read the SEC complaints for those tokens, one major difference and problem for them is that both of their "Labs" entities conducted fucky stuff with their tokens AFTER their mainnet through buybacks/additional security offerings.
