I think the hedgies hand-walked us down to $0.05 and after several days of price increasing they found they were forced to step back in and manually control the price exactly as they did from Feb6th until last week. I think they thought taking us so close to the edge would get people to walk away but buyers are showing up.
I can't make heads or tails of this in terms of game theory. hedge funds can't FORCE this company to go bankrupt, and I think this play REEKS of desperation. I think whoever is shorting the fuck out of BBBY are doing it in a do-or-die fashion because they are ALREADY dead to GME shorts. If an entity's capital is already tied up in a short position, they likely are FORCED into continuously shorting and they chose BBBY as the blood-sacrifice. However they were outmaneuvered. Removing the shorts from GME involves destroying them on another battlefield. And being a naked short institution that has no right to exist, plenty of people would love to see them destroyed as this would free up an UNGODLY amount of capital for GME to expand at a fair price similar to other companies actively traded on the market. GME is tamped down BECAUSE of the short position. This paradoxically makes it a screaming buy, however the price action never seems to move higher DESPITE having no debt makes them very resilient to market crashes given they can be financed through their own operations.

If there's going to be a merger or acquisition announced it would be in the 10K when it's filed. If it's not, then the only hope I can think of would be a buyout at auction and everything being handled such that shareholders don't get screwed either with an issuance of new shares like what happened with Hertz or an issuance of shares from the party that purchased the company at auction. What the ratio would look like I have no clue, Hertz shareholders got what was considered a good deal and they got a 1-for-20 issuance of shares for the new ticker of the company.

I'm hoping there's an M&A announcement in the 10K myself but there's still some hope if there isn't. Ultimately the final deadline for everything would be the end of the month/first week of June as IIRC the wind-down would be completed by 6/9 and the auction ends on 5/22

There's actually quite a few loopholes in all of it and I was just about to type that up in a post. Companies with a float between $75 million and $700 million have 75 days. If it's based on the float and the float is less than $75 million they have 90 days. But they filed their NT 10-K on April 26, 2023 which was exactly 60-days after their fiscal year end which lines up exactly with when Large Accelerated Filer ($700MM or more) are due which would mean the 10K would be getting filed today and presumably announced/made public tomorrow. Reporting requirements based on valuation go off of what the company was worth in market cap at end of fiscal year which would put them in the Large Accelerated Filer category meaning it would be filed today and made public tomorrow, what the market cap is now is basically irrelevant for this purpose and even if they delayed the 10K because of bankruptcy proceedings it still would've been due today per the 15-day extension filed. But ultimately, the judge for their case can change reporting requirements based on the companies circumstances so everything I've typed out might not matter at fucking all per his decision, and there's also the matter that not every company being acquired by another HAS to file a 10K for end of fiscal year. Technically they're supposed to but in reality they don't have to unless they want to.

You'd need a regulatory reporting expert to give a better idea as to what will/might happen but this is the broadstrokes. There's a pretty good chance the 10K got filed today and will be made public tomorrow, but there's also a chance it might not be filed at all or might be delayed even further. Point still stands that if nothing happens by 6/9 it's dead done and dusted so that's still the ultimate deadline.
