Thanks for your effort post anon. I think that we are going to see a reasonable compromise be reached by both Ripple and the SEC. There is a lot of overlapping ground in their arguments and I don't understand why their legal teams are both playing hardball when it clearly isn't necessary.
From Ripple's perspective: it is ridiculous to be shaken down by a corrupt governmental agency trying to use your company as an exercise in jurisdiction enforcement. They have the Hinman email card to play and the fair notice argument is a fair play in my opinion. However, the initial sales can be shoehorned into a security definition if the quantity covered is sufficiently restricted. As the alleged tort decreases, the rationale for jurisdiction becomes easier to make but even less important. Even if no more than 1 token ever sold fit the security criteria, does fining them a few dollars really promote justice?
From the SEC's perspective: they are a shark like agency tasked with hunting down sophisticated wrongdoers. It makes sense why they would go after the oldest non-BTC in the world but it makes zero sense why ETH gets a pass. Or FTX. This lawsuit, and the associated emails, could prove fatal for the entire agency and they are crazy to continue pursuing it.
I think that Ripple will delete the emails, pay a small fine ($1M etc) as an act of goodfaith to cover court costs, be given absolute regulatory clarity, and then skyrocket into the low thousands per token, eventually hitting Cahill's targets. The SEC will accept a fair notice defense as part of the settlement, define all ICO's as securities moving forward, and proceed to rape most of the shitcoins into oblivion. In a sense the current bank meltdown is a blessing because mainstream investors have a chance to liquidate fatal crypto positions to free up liquidity and end up saving some of their capital from the total carnage which will come from clarity.

If these bank failures cascade and let's say Ripple case favorably at same-ish time, XRP boosts to $29-$40, what then? Let's say you send some XRP to and exchange, Uphold for example. You convert XRP to USD. Could you even have that wired to your financial institution? If you could, would your FI give you cash or let you pay off your mortgage with a bank transfer? Many questions. I'm thinking I might need to buy gold from Credit Suisse and have them mail me the physical gold. Would people even want or accept USD Fiat if banks crash? Even if you have gold, what the hell can you do with it. Let's say 1 gold ounce is worth $50,000 USD. Where would you be able to go to sell 1 ounce of gold?
