Basically yes. Really he was talking about a settlement. But even if initial summary judgment outcome, it will narrowly tailored to this specific case in dicta. That outcome would be potential ammo for defendants but not enough to hang on. Also depends if fair notice defense is what they lose on which will be particularly specific to Ripple given their history of SEC engagement that few other coin company's have been involved with.

Either way of SEC gets worried about precedent they will settle. And XRP will be lone survivor.
