That's literally what the lawsuit is about. The SEC is trying to argue that early sales of XRP we're securities. Ripple is arguing two main points: One, that early sales did not constitute a security because there was no investment contract or reasonable expectation of gains as a result of ripples input. And 2, that there was no fair notice that ripple was selling unregistered securities, basically that the SEC gave no guidance to the markets on what a security is and that they gave ripple no warning that what they were doing was wrong.

The first point isnt as important as the second IMO. Perhaps ripple pays a fine based on their early sales of XRP, big deal.
The second argument could literally change how all cryptos operate within the US and rip control away from the SEC, this is the reason the lawsuit is taking so long. Not because the SEC really cares if ripple gets off, but it stops them from going after other cryptos and regulating y enforcement/ie suing whoever is an easy target or most convenient for them to make their organisation the most money.

That's the down and dirty about the lawsuit.

i've had the lambo money in the past (exited 12/2017 after DCAing since 2013) but regrettably my ex decided most of that was hers. spent years in litigation and lambos on lawyers. ivnested the little i had left over from that wisely since then, which brings me to now.

i spent the last year looking after my two kids which i now have fulltime (ex just wanted my cash not the children) and that has been pretty much it. tried other endeavors but they have gone nowhere.

after much contemplation i blame myself because i just cant invest the hours into independent initiatives like i used to in my 20s.

am in my mid 40s now and loathe working with others, specifically authoritarian nonsense. it's not the team work its the brogrammer crap that tech is surrounded by.
wuz a d&d dork back in my youth and got the shit beaten out of me for having tourettes.

i aint complaining, just saying i paid my dues as a nerd.
