52503507 No.52503507 [Reply] [Original]

Guys I think my job accidentally overpayed me a shit ton of money
>2 days ago get abruptly laid off from job
>be told I will be paid off remainder of contract + accrued PTO in one lump sum
>yesterday find out there's more mass layoffs
>based on the math I did I should be expecting about 12k give or take
>wake up today and see notification that I received a direct deposit
>almost fucking $30k
>Holy fucking shit
>think I'm just groggy and put the phone down and try to go back to sleep
>check again in an hour, it's still fucking there
>check the deposits, I notice 3 duplicate deposits of money
>check ADP and go to pay and tax section
>only find the singular entries that amount to the original 12k-ish I actually anticipated
>think someone screwed up and overpayed me a shit ton of money
>no longer work for them and i don't wanna give them back the money
Holy shit wtf do I do? Can they take me to court for it or something? What is the best way to secure this money and keep it from them, I am almost sure this was a mistake on their part but FUCK THEM.

also i'm pretty sure they're going to make this painful for you because they withheld taxes from the amount. they'll demand you repay them the gross (pre-tax amount) and then reflect it on your W-2.

e.g.

you were paid $40k gross. you see $30k post-tax in your account because they withheld $10k in taxes. they'll ask for $40k back. your W-2 will show an extra $10k of tax withholding, which you will get back in a tax refund.

"As such, having identified an overpayment post-termination, the employer will need to request repayment from the employee. This should be done informally at first, albeit in writing. In the event that the employee refuses to repay the sum owed, it is open to the employer to take legal action against them. This would involve issuing a civil claim for recovery of the overpayment as a debt."

They can get mad it but technically it won't be your fault, it was just an unfortunate concidence. Then they'll have to do a bunch of legal bullshit to try and get the money back and you can delay delay delay and "accidentally" mess up this and that paper form they were waiting for for a month and... oops, I guess this $18k isn't really worth all this time over one employee. If you don’t hear anything then you’ll just be an accounting error lost to the ether. I personally wouldn’t say anything and stick it in a savings account or the like and wait 7 years until you start spending it in earnest.

I say don't spend the money for a year or two. If nothing happens after that time then I'd say you're in the clear. But on the other side of things, if they never disclosed how much money you were supposed to get and only told you you were getting a lump sum of money, you could probably feign ignorance to how much money you were truly supposed to receive and thought the 30k was yours if it came down to it. Only thing is I don't know if you're willing to go through all that legal court system bs if you go down the 2nd path. Tbh just stick with the first option since there's much less stress. This happened to me once in the UK. I continued to be paid by my former employer for four months after leaving. I called them after the second payment to report it and they did nothing. Eventually I got a letter from their legal team and paid it all back straight away. Two months later I had a debt collection agency try to recover the money I'd already paid, luckily I had evidence to prove I'd paid it all. Anyway my advice is to call them and pay them back as I'm sure that legally it's not your money.

You probably will have to give it back.

You might have a case if they actually quoted you the wrong amount or had you sign a document with that amount.

They also might never realize - but I would be careful. My wife's company just went after a guy who had received several months of double pay (deposits to two accounts) and it was like 6 months after the last deposit.

If they do ask for it back, I'd just do it and move on.
