I understand that mining pools can refuse to include transactions that involve "tainted" Ether. Is there a workaround? Can one make his own validator node (requires 32 ETH) and just include my own transactions in it? What about L2?

I think the govt fucked themselves by playing their hand too early. They basically outed every party that was desperate to lick the boot, and gave the ETH core devs a heads up that the govt was going to try and push protocol level censorship.
If they had waited 6 months and done a much more multi-pronged attack, it would have had a lot more impact, but just hitting TC and arresting the dev has shown their hand for little benefit.

But even then I'm guessing since validators are randomly chosen, it may take a while for your transaction to be validated? Do you think L2 privacy layer could circumvent protocol layer censorship?

You can't really shut down Ethereum validator nodes. How? Bitcoin miners can be shut down due to the high energy imprint they leave. You can probably spot them from orbit. But in terms of energy you can't easily find the geographical location of Ethereum nodes.
