Bend over backwards as much as you like to explain it away. ETH is an unregistered security under the Howey test. Whether it will end up being enforced is a different question. SEC doesn't want to "strifle innovation" so they might end up going home. Then again they didn't really do anything until Ripple and look at us now, they are investigating Binance chain, coinbase and kraken (iran sanctions). Maybe the SEC is only getting started now. They had very little staff and could only rarely go after anyone, so they focussed on criminals that they knew they could nail. If they thought there's little success they didnt bother, even if crimes were commited. Either way, things are heating up lots atm
