I think that's more of a weakness of the political system (democratic republic) rather than the economic system. Imagine instead if we had a free market economy, as a nation, but instead of plebian electives trading under the table and vying for power via lobbying and dick sucking, you have a Constitutional Leader (almost like a führer), who has executive power within the Constitution, chosen by the high IQ of society (Sapian Council of Judges) but can be ousted by the people at a high ratio (say 75/80%). The fact that the end-state was one in which plutocrats used their monopolistic position to buy politicians to boost their profits and entrench their positions further is not a refutation of the idea that they wreaked plenty of havoc with maneuvers that are "fair game" in a hypothetical pure free market like you think it is. The troubles of that era were not addressed merely by making the politicians stop taking bribes and letting the market do the rest - the monopolies were knocked down a peg directly too, period, and you're going to have to do a lot of mental gymnastics to come up with a way that this part of the historical record somehow proves your point too.

those anti-trust actions had a lot of politics behind the scenes and while I'm not too familiar with a lot of them, I know that for instance the one against microsoft was more of a way to force the company to play ball with Washington because prior to that they did not send lobbyists to the capital. I know it's a somewhat paranoid statement but overall I think there is way more opportunism and selective enforcement in government action than we are aware of and the narratives we are told about those actions tend to be designed to please us (and no matter how smart we think we are we are not immune against propaganda).

that being said I think you are missing the point because essentially what I am trying to say is that to creat any kind of market inefficiency (that means a profit potential exceeding the limits of what is possible in a un-distorted market) means expanding a amount of "economic energy" (money) that undermines the resulting profit from said distortion - (or basically: unless you involve the government you're most likely going to go broke creating the monopoly and if you manage to create it you'll find that you can not exploit your pricing-power because that creates the very forces that will destroy your monopolies ... )

therefore: yes, I think that the existence of those law-suits does not undermine my argument as you would find to see a lot more of those law suits if it was truly that easy.

dude, my point is that they bought politicians to erect their monopolies - and without the possibility to do so they would have be able to do their supposed evil deed (which by the just so you know: a lot of that perception is actually the result of "marketing campaigns" spread by their competitors)
