The IRS in the USA is extremely understaffed. I called about a separate issue about 5 years ago and they admitted my documents have just been sitting in limbo for over 7 months because of confusion with my name. They have only gotten worse since then.
Also I have been trading back and forth between USD and all manner of crypto for years.

Coinbase used to let you download an Excel spreadsheet of all your trades (not sure if they still do). This document is extremely easy to forget and then print showing a loss. I did this around 2017 and the IRS accepted it as evidence of income with no problem.

I’m a tax lawyer and deal with this all the time. So Im assuming facts are:

You’re not going to get turbofucked like some are saying, but you’re skating on some thin ice I’d say. Your W2 gets reported to them every year and there’s a good chance they will file returns for you. Once they do they will send a lock in letter to your employer to mandate full withholding and/or get a revenue officer on your case if you make good money. You might get a way with it though I’d say 35% chance of paying less than you would owe in the end.

If I file correctly even after receiving a notice, I should be able to file for quite a lot of credits and deductions still. So much so that I considered just paying my taxes a few times, but now I'm convinced I keep more by not paying them, but it's not that much in comparison. Does this opportunity to properly file once found out go away after my company gets that letter?

And even if they do mandate full withholding, ultimately this would just be like giving the IRS a loan, so I should be able to get a large amount back at the end of the year.

Relevant statutes of limitation:
1. Refund: 3 years from the due date of the return or 2 years from the payment. In your case this means that even if you were due a refund on your 16 & 17 returns you will not see it.

2. Assessment: if you do not file a return the IRS can file for you at any point in the future. In practice this is 10 years because that’s how long they keep income info.

3. Collections: 10 years from the date of assessment. You need to have the tax owed for this to start running, which in your case has not happened because you haven’t filed. They will have 10 years to collect once you file or they file.

You could come out on top from this, but preferably you need to be paid in cash and stop getting a w2. If they start filing returns for you then you’re going to start having problems. Until that point you’re ok.

Sometimes people get lucky and the IRS doesn’t do it for a long time, but I’ve seen the IRS file returns 5-8 years later. The longer you go this route though the riskier it becomes. Eventually there’s a good chance a revenue officer will get involved and make you file a bunch of returns or they’ll do it for you and start to levy your bank or garnish wages.

The way you come out ahead is two possibilities from how I see it:
1. You file all returns, don’t pay the tax owed, and the IRS writes off the debt in 10 years.

2. You don’t file any returns, stay exempt and don’t withhold, and pray the never file for you.

3. You file returns and pay going forward, but not the back tax years, then pray they never file returns for you.
